I am currently on H1b applied for 485, LC Cleared, I140 Cleared.
I work for a company X but own another consulting company and I am a passive partner with a share of 49%. Another friend of mine who is also in the same boat as I am is another partner with 49% stake. My Sister who is a Green Card holder has 2% Stake and is an active partner.
I have not taken a single penny from the company in the last 2yrs we formed the company and we file a K1 every year. Even though the company makes profits/loss we are not taking the profit nor writing off the losses from our individual taxes, However both of us (I and my friend who are passive partners) end up doing most of the work such as
1. Signing the bank checks
2. Signing the USCIS documents for employees who are working for our company.(for I129, etc etc)
Does this mean that I am a clear candidate to be on INS Red alert/Radar?
I know that an H1b holder can have a company on H1B and cannot work for that company part time/full time precisely what I have been doing since I have never taken a pay check from the company however I never thought that this could have implications on the 485 approval.
Can some one answer my question. I guess I am more looking at some one like UnitedNations to answer.

Hi, I am on L1B since Dec'10. My visa is expiring in Apr'11. Due to project requirement, my company has plan for my visa extension. Is there any way to get the GC? If part-time study can help to process my GC faster, I am ready for that too.

There is no way for you to go faster...there are people waiting 5-10 years ahead of you, and you will have to join at end of the line; Even full time study is not going to help you get the GC faster.

On May 18, 2009, the Texas Senate passed a bill requiring Sheriffs or any other officers in charge of a correctional facility, to determine the “citizenship status” of all convicted felons. The bill, S.B 2584, amends Chapter 2, Code of Criminal Procedure, by adding Article 2.245. If a defendant has been convicted of a felony under Title 5 (Offenses Against the Person), Penal Code, Title 6 (Offenses Against the Family), Penal Code, Title 7 (Offenses Against Property), Penal Code, Chapter 43 (Public Indecency), Title 9 (Offenses Against Public Order and Decency), Penal Code, Chapter 45 (Weapons), Title 10 (Offenses Against Public Health, Safety, and Morals), Penal Code, and Chapter 481 (Texas Controlled Substances Act), Health and Safety Code, the sheriff or officer will make a reasonable effort to determine the defendant’s “citizenship status”. If the sheriff has reason to believe the defendant is a foreign national, within 48 hours after the defendant is received at the correctional facility, the sheriff or officer will contact the Department of Homeland Security (DHS) to verify the defendant’s immigration status. The bill becomes effective September 1, 2009.

I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

hello all,
I wanted a clarification regarding address change:
My company changed address recently from address City A to address City B (same county, same metropolitan area). Do you know if I need to do any LCA Amendment?
I had consulted a lawyer regarding this, he said we don't need to do any LCA Amendment since it is the same metropolitan area.
Also I am not getting any clear answers from any other websites.
Wanted to cross check with you all. If anybody know please help.

I always wonder these ARAVAS deserve GC?
Because where ever they will make lot of fuss there and cause so many troubles to hosting country...
Srilanka they made a beautiful country as almost ash because of their perverted intensions..And Singapore they will never go with country's best interests...and Malaysia....
And even in India see the support to LTTE (Openly)
Also all most all these ARAVAs are blue collar cheap labor, I don�t know how a considerable number of Tamils getting h1b

b) Company A applied I-140 and approved April 2006. AOS 485 filed on July 2007. Got EAD but never used it
c)September 2008 I have Joined employer �B� by transferring H1B (Valid until Aug 2010).
d) Employer A revoked 140 which triggered 485 denial in October 2008.
e)Applied MTR and it was approved in NOVEMBER 2008 and 485 reopened.
f)Applied AP & EAD renewal ,got a EAD card September 2010
g) Since EAD extension got delayed I have applied H1-B Renewal August 1st week of 2010 and got a RFE now asking for proof how beneficiary qualify to extend beyond six years?

1)I have EAD approved and it�s valid until 2012 September .Is it possible can we withdraw HI-B Petition application when they request RFE?
2)Can I have any chance of explain USCIS, by this rule below?

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.

I believe CGFNS is for foreign nationals who train outside the US. If you train here, I don't think you need it.
Well, when I talked to lawyer, even though he knew I have degree and Nclex from US, he asked me to get CGFNS visa screen.
Does this makes sense?

How will removing country limits help China, India and ROW.
Has someone done any calculations on visa date movement.
We should have some comparison on this because some of us from China against. I seen many ROW against.
Does it help only Indians or everyone by how much?
I see these calculations bringing Indians, Chinese and ROW together.
the truth is this.... some of the chinese are against removal of country limits becoz they do not care if it helps them..... they r simply opposed to removal of per country limits becoz they cannot see india getting any benefit..... its the age old chinese mindset which cannot be changed with numbers or calculations...... otherwise just think for u'rself...... if china is retrogressed as evident from monthly visa bulletin .... & removal of per country limits will create 1 queue for everyone..... then y would some of these chinese be opposed to the removal of per country limits.....
